RACINE, Wis. – A 26-year-old Racine man is charged with shooting at a Racine bar on New Year’s Day 2019. The accused is Juan Garibay – and he faces the following charges:
- Attempted first degree manslaughter
- Possession of a firearm by a criminal
- Breach of bail for misdemeanor
According to the criminal complaint, Racine police were dispatched to the Game On Sports Bar on State Street in Racine on January 1, 2019. Officers responded shortly before 2 a.m. after a report of gunshots.
When officers arrived at the scene, they located the victim in the basement “suffering from a gunshot wound to his arm, for which he refused further medical attention other than a large bandage,” the police said. complaint.

When the victim was questioned, according to the complaint around 1:30 a.m., he noticed disturbances and went to help. This issue involved a woman “who he told to leave the bar because she wouldn’t calm down.” A male companion of this woman became involved – and the victim asked him to leave. The victim told police he escorted the man outside. Once there, the victim said that “the man clashed with him and was going to fight the victim. (The victim) indicated that he threw himself on the individual and missed him , after which he heard a gunshot behind him,” the complaint reads. It was then that the victim realized that he had been shot in the arm. He told police “he was shot by one of the friends of the individual who arrived with the guy he was fighting with,” the complaint states. However, the victim was unable to provide any information about the shooter, only a description of the man he was fighting.
The complaint says investigators reviewed surveillance video outside the bar. This confirmed the victim’s story. It also shows “the alleged shooter exiting a silver/gray Ford Escape SUV with other people, including a woman who was still present in the bar,” the complaint states. Police were able to identify the woman – and when they spoke to her she told police she was present with two men – one of them Garibay.

The surveillance video detailed Garibay “removing a handgun from his belt and handing it to a light-skinned, bearded man,” the complaint states. Later, the bearded man “fired a shot at the group”.
The victim told police Garibay did not shoot him, but unnamed sources told him another man shot him – and he had a picture of that person. It was the bearded man.
The complaint in that case was filed on January 17, 2019. But Garibay was not in police custody at the time – and an arrest warrant was issued. On June 17, 2022, Garibay appeared for his first court appearance in Racine County Court. Cash bail was set at $50,000. Garibay is due back in court on June 23 for a preliminary hearing.
